SUNBURY - The sentencing for a 35-year-old Coal Township woman convicted in January of drug-related offenses, which was continued last week, has been rescheduled for 1:30 p.m. Monday, June 4, before Northumberland County President Judge Robert B. Sacavage.
Diane (Reichwein) Delvalle will be sentenced on two counts each of possession with intent to manufacture or deliver a controlled substance and criminal conspiracy relating to incidents that occurred in the parking lot at McDonald's along Route 61 in Coal Township on Nov. 4, 2007, and Dec. 6, 2007.
A difference of 12 feet could determine if Delvalle receives a mandatory jail sentence.
On May 14, Sacavage delayed the sentencing for at least two weeks to allow Delvalle's attorney, Michael Morrone of Williamsport, to hire an independent surveyor to determine the exact distance from where the offenses occurred to the Springfield Playground on Maple Avenue near Tioga Street.
If it's determined that the crimes were committed within 250 feet of the playground, Delvalle will be ordered to serve a mandatory prison sentence of two years for each of the offenses, which means she could receive a mandatory four-year jail sentence. A mandatory prison sentence is imposed for drug offenses that occur within 250 feet of a school zone, playground or licensed day care.
Delvalle remains free on $80,000 bail.
