Mt. Carmel man found guilty in 2010 assault

SUNBURY - A Mount Carmel man was convicted on all counts related to an 2010 assault in the borough.

District Attorney Tony Rosini announced Jason M. Bozarth, 33, of Mount Carmel, was convicted of all the charges filed against him, including criminal conspiracy to commit aggravated assault and aggravated assault, both felonies of the first degree, and each punishable by a maximum of 20 years in prison and a $25,000 fine; simple assault, simple assault by physical menace, and recklessly endangering another person, all misdeamenors of the second degree and each crime punishable of a maximum sentence of two years in prison and a $5,000 fine; and a third-degree misdemeanor count of disorderly conduct with a maximum sentence of one year in prison and a $2,500 fine.

The conviction came after a two-day jury trial in Northumberland County Court before Judge William H. Wiest.

Bozarth was charged after an incident in Mount Carmel on Aug. 18, 2010, when Mount Carmel Police Cpl. Christopher Buhay and other officers were dispatched to a serious assault in the area of Market and Sixth streets. Bozarth was arrested after breaking the victim's jaw and causing numerous cuts, scrapes and abrasions.

The jury convicted Bozarth after hearing two days of testimony and deliberating for four hours, rendering their verdict at 9:30 p.m. Feb. 17.

After the jury's verdict, Assistant District Attorney William C. Cole, Esq., made a motion to increase the defendant's bail to $100,000, which was granted by the judge. Bozarth was immediately committed to Northumberland County Prison.

Rosini commended Buhay for his excellent work in investigating and filing the charges and also commended Cole for his thorough trial preparation and outstanding trial presentation.
